কনডেম সেলে বন্দিদের
মানবেতর জীবন
খুলনার জাহিদ শেখের বর্তমান বয়স ৪৮ বছর। স্ত্রী
ও এক সন্তান হত্যার দায়ে মৃত্যুদণ্ড মাথায় নিয়ে
২০ বছর ছিলেন কারাগারের কনডেম সেলে (নির্জন
প্রকোষ্ঠে)। অবশেষে চূড়ান্ত বিচারে নির্দোষ
প্রমাণিত হলে সুপ্রিমকোর্টের আপিল বিভাগ তাকে
খালাস দেন। কারাগার থেকে মুক্তির পর জাহিদ
জানালেন কনডেম সেলের দুর্বিষহ জীবনের কথা। যে
কোনো সময় ফাঁসির মঞ্চে যেতে হবে-এমন আতঙ্কের
মধ্যে দিন কাটত তার। দীর্ঘ এ সময় পাশাপাশি থাকা
অনেকের ফাঁসিও দেখেছেন। তিনি বলেন, কখনো ভাবিনি
ছাড়া পাব। আমি নির্দোষ ছিলাম। কারাগারে ২০
বছর অনেক কষ্টে কেটেছে। আমার এখন কেউ নেই, কিছু
নেই। জেলে থাকা অবস্থায় মা-বাবাকে হারিয়েছি।
নিজের বাড়ির সম্পত্তি বলতে যা ছিল, মামলার খরচ
চালাতেই চলে গেছে।
সম্প্রতি এমন বেশকিছু পুরোনো মামলায়
মপ্র“্যদণ্ডপ্রাপ্ত আসামিকে বিচার শেষে আপিল
বিভাগ খালাস দিয়েছেন। কাউকে দিয়েছেন যাবজ্জীবন,
আবার কারও মৃত্যুদণ্ড বহাল রেখেছেন। তবে
হাইকোর্টে বেশকিছু ডেথ রেফারেন্স শুনানির
অপেক্ষায় রয়েছে। মামলার দীর্ঘসূত্রতার কারণে
অনেক নিরপরাধ আসামি বছরের পর বছর কারাগারের
কনডেম সেলে মানবেতর জীবনযাপন করছেন। এদিকে
তিনজন মৃত্যুদণ্ডপ্রাপ্ত আসামি কনডেম সেলে
রাখার বৈধতা চ্যালেঞ্জ করে সম্প্রতি রিট দায়ের
করেছেন। শুনানি শেষে হাইকোর্ট
মৃত্যুদণ্ডাদেশপ্রাপ্ত কারাবন্দি ও কনডেম
সেলের সংখ্যা, কারাগারের সংস্কার, ব্যবস্থাপনা,
কনডেম সেলের সুযোগ-সুবিধা সংক্রান্ত প্রতিবেদন
চেয়েছেন।
জানা যায়, বিচারিক আদালত কোনো আসামিকে
মৃত্যুদণ্ডের সাজা দিলে সেটিকে কার্যকর করতে
অনুমোদন লাগে হাইকোর্টের। এটিকেই ডেথ
রেফারেন্স বা মৃত্যুদণ্ড অনুমোদন বলা হয়।
হাইকোর্টের রায়ের পর সংক্ষুব্ধ পক্ষ আপিল
বিভাগে আপিল করতে পারে। আর আপিলে আসা
সিদ্ধান্তের পর তা পুনর্বিবেচনা চেয়ে
সংক্ষুব্ধ পক্ষের আবেদনও করার সুযোগ আছে। ডেথ
রেফারেন্স শুনানির পূর্বপ্রস্তুতি হিসাবে
পেপারবুক তৈরি করতে হয়, যেখানে মামলার এজাহার,
অভিযোগপত্র, সাক্ষীদের বক্তব্য, বিচারিক
আদালতের রায়সহ মামলার তথ্যাদি সন্নিবেশিত থাকে।
সুপ্রিমকোটের রেজিস্ট্রার জেনারেল আলী আকবর
বলেন, এ বছর আপিল বিভাগে বেশকিছু পুরোনো মামলা
নিষ্পত্তি হয়েছে। হাইকোর্টেও ডেথ রেফারেন্স
শুনানি হচ্ছে। করোনার কারণে কিছুটা প্রভাব
পড়েছিল। এখন সেই অবস্থা নেই। আশা করছি,
মামলাজট থাকবে না। মামলাজট নিরসন হলে মামলার
মারপ্যাচে বিনাদোষে আটক বন্দীগণ তাদের ন্যায্য
অধিকার ফিরে পাবে।

Women leaders'
network needed for gender equality: PM Hasina

Prime Minister Sheikh Hasina underscored the need
for forming a Women Leaders' Network as it would
help ensure gender equality.
She said: "It is greatly empowering to be with you
all. I strongly feel that we can establish a Women
Leaders' Network which can bring us together, not
just for one-off meetings, but to act as a force to
ensure real actions to achieve gender equality."
Sheikh Hasina was addressing a high-level meeting on
Women Leaders, convened by the President of the
General Assembly.
Besides, she placed three proposals before the world
leaders at the meeting that need to be addressed
properly to ensure gender equality.
"I commend you for founding the Advisory Board on
Gender Equality. This now needs to be localized. We
need gender champions at every level, especially at
the grass roots level, and we can lead by example,"
said the Bangladesh PM.
Secondly, the women-led organizations need to be
nurtured and supported with sufficient political and
financial means, she said, adding the UN has an
important role in supporting such efforts.
Sheikh Hasina, in her third and final proposal,
said, "I invite you to convene a leaders' summit to
reinforce our common agenda for gender equality. All
leaders - not just us - should join and present
concrete commitments for advancing gender equality."

1315 people died of Covid-19 in
September 2021

Human Rights Report:
The documentation section of
Bangladesh Human Rights Commission (BHRC) and
International Human Rights Commission-IHRC jointly
furnished this human rights survey report on the
basis of daily newspapers and information received
from its district, sub-district and municipal
branches. BHRC survey found a total of 208 deaths in
the killings. According to official figures, 1315
people died of the Covid-19 in all over the country.
In September 2021, there were an average of 44
Covid-19 deaths and 7 deaths in killing per day. The
Law enforcing agencies and related Govt. departments
should be more responsible so that percentage of
killing May be brought down to zero level. To
institutionalize the democracy and to build human
rights based society the rule of law and order must
be established everywhere. Through enforcing rule of
law only such violation against human rights can be
minimized. 1315 persons died by corona virus in
August 2021 according to official estimates.

UN in talks with Bangladesh govt. to review DSA: Mia
Seppo

The United Nations' Resident Coordinator Mia Seppo
on Sunday said the UN is in talks with Bangladesh's
law ministry to review the Digital Security Act (DSA)
and stop its misuse.
While responding to a question about elections in
the country, she said the UN is also willing to
cooperate if Bangladesh wants it to.
The UN resident coordinator also conveyed the global
organisation's concern over signs of shrinking civic
space, growing inequality and violence against women
in Bangladesh.
"Global shrinking of civic space is a big concern,
but for a country that aspires for democracy, it is
not healthy," she said.
Mia Seppo made the remarks during an event organised
by the Diplomatic Correspondents Association of
Bangladesh at the Foreign Service Academy in Dhaka.
She further said the proposal from the World Bank
regarding Rohingyas in Bangladesh has been
misunderstood.
"The solution to the Rohingya refugee situation lies
with Myanmar," she said. "The most viable, durable
solution is the voluntary repatriation of refugees
in safety, dignity and sustainability," she said.
Mia Seppo said the United Nations supports the World
Bank's global refugee policy, although many
countries have and will have differences in global
policy with local policy.
Announce orders in
open court SC directs lower court judges

The Supreme Court administration on Wednesday issued
a notification asking the judges of the subordinate
courts across the country to deliver their all ad
interim orders including the bail and verdicts in
the open court in the presence of the parties
concerned or their lawyers.
Md Golam Rabbani, Registrar of the High Court
division of the Supreme Court, issued the
notification with the instruction of the higher
authority.
The High Court Bench of Justice M Enayetur Rahima
and Justice Md Mostafizur Rahman in a verdict
delivered on September 2, 2021 asked the lower court
judges to announce their all ad interim orders
including bail orders and verdicts in the open court
in the presence of the parties concerned or their
lawyers to ensure transparency and accountability,
said the notification. In this circumstance, all the
judges of the lower courts have been directed to
follow the directions mentioned in the judgment of
the High Court, also read the notification.
The High Court Bench by that order cancelled a lower
court order that granted bail to suspended deputy
inspector general (DIG) prisons Partha Gopal Banik
in an "unusual manner" in a case filed over the
recovery of Tk 8.0 million from his residence in
Dhaka.
The High Court at the same time asked the suspended
official to surrender in the trail court by
September 20 this year. It also ordered to transfer
the case to the speedy trail tribunal-4 in Dhaka and
asked the tribunal to complete the case by February
28 in 2022.

Security to
Bangabandhu's family: SSF Bill placed in parliament
Human Rights Report:
Special Security Force Bill, 2021 was placed in the
Jatiya Sangsad aiming to bring the family members of
the country's founding president Sheikh Mujibur
Rahman, alongside the president and the prime
minister of the country, under life-long security
coverage of the force.
Liberation War Affairs Minister AKM Mozammel Haque
today placed the bill in the House with Speaker of
the Jatiya Sangsad Dr Shirin Sharmin Chaudhury in
the chair.
Piloting the bill, the minister said the proposed
bill has been placed for amending the previous
Special Security Force Ordinance 1986.
On May 17, the cabinet in principle endorsed the
draft bill that incorporated family members of
Sheikh Mujibur Rahman for providing lifelong state
security to them at home and abroad.
The cabinet secretary on that day said that Sheikh
Mujib's two surviving daughters, their husbands and
children would get SSF for their security according
to the proposed law.
He said that the very important persons like the
head of the government or state from foreign
countries or anyone designated as a very important
person by the government in the country also get SSF
security coverage.
Bangabandhu Sheikh Mujibur Rahman was assassinated
along with all but two of his family members on
August 15, 1975, at his Dhanmondi residence in Dhaka
by a group of army personnel.
His daughters - Sheikh Hasina, now the prime
minister, and Sheikh Rehana - survived the massacre
as they were abroad at that time.
The principal duty of the force is to provide
physical security to the president and the prime
minister.
'The proposed law would replace the Special Security
Force Ordinance 1986, which was a martial law
proclamation and was nullified by a High Court
Order,' cabinet secretary Khandker Anwarul Islam
told a press briefing after the meeting.
The minister urged the house to sent the bill to the
parliamentary standing committee on Law, Justice and
Parliamentary Affairs Ministry for providing report
within 30 days.

Bangladesh
seeks US investment
Human Rights Report:
State Minister for Foreign Affairs Md Shahriar Alam
has invited US investment in Bangladesh and
requested the USA authorities for providing
duty-free market access to Bangladesh products. The
state minister participated in a meeting with Wendy
Sherman, Deputy Secretary of State of the USA along
with other ministers and senior officials from
Bhutan, Maldives, Nepal and Sri Lanka in New York on
15 September.
During the meeting, ShahriarAlam highlighted the
social and economic developments of Bangladesh even
during the Covid-19 situation under the visionary
leadership of Prime Minister Sheikh Hasina.
He also talked about the climate challenges faced by
Bangladesh and other climate vulnerable countries,
and the pioneering role played by Bangladesh in
addressing these challenges.
Myanmar monks march
against military junta
Human Rights Report:
Scores of pro-democracy Buddhist monks took to
the streets of Myanmar's second-biggest city
Saturday, rallying against the military coup in
demonstrations that coincided with the 14th
anniversary of previous clergy-led mass protests,
reports AFP.
Myanmar has been in turmoil and its economy
paralysed since February when the military ousted
Aung San SuuKyi's civilian government, ending a
ten-year experiment with democracy.
Around the country an anti-junta resistance has
taken root, prompting the military to unleash a
brutal crackdown on dissent. More than 1,100
civilians have been killed and 8,400 arrested,
according to a local monitoring group.
Historically, monks in predominantly Buddhist
Myanmar have been seen as a supreme moral authority,
organising communities and at times mobilising
opposition to the military regimes. But the coup has
exposed a schism in the monkhood, with some
prominent clerics giving the generals their blessing
and others supporting the protesters.
On Saturday, dozens of monks in their bright orange
and crimson robes marched through the streets of
Mandalay with flags and banners and threw colourful
streamers in the air.
"Monks who love the truth stand on the side of the
people," a protest leader told AFP.
US army have proved
pathetically unfit and undependable
Human Rights Report:
Gen. Mark Milley, chairman of the US Joint Chiefs of
Staff, has called the 20-year war in Afghanistan a
'Strategic failure' and that he believes the U.S.
should have kept several thousand troops in that
country to prevent the unexpectedly rapid takeover
by the Taliban.
Defense Secretary Lloyd Austin and Commander of U.S.
Central Command Gen. Kenneth McKenzie also testified
during a Tuesday hearing before the Senate Armed
Services Committee. The entire war that followed the
9/11 attacks on the US by the al-Qaeda of Osama Bin
Laden in 2001 came up for critical review during
hearing.
It featured rigorous questioning from lawmakers on
both sides of the political divide. Democratic and
Republican lawmakers alike criticised the chaotic
withdrawal that saw U.S. troops try to coordinate a
mammoth evacuation of Americans and Afghan allies.
The defence services men upheld their actions during
the chaotic withdrawal from Kabul in August but
could not conceal the fact that their mission in
Afghanistan failed as it did in Vietnam 48 years
before in the early seventies of the last century.
Observers don't miss the point that the Taliban
which the American forces went to destroy only
emerged stronger after the 20-year war. In both
Vietnam and Afghanistan the US forces not only
conceded defeat but also virtually ran out from
unsecured positions. It's a great shame for a world
power like America to have embraced this following a
war that cost 2,461 American lives and two trillion
dollars.
